Purpose and legal basis of personal data processing

BORNFIGHT d.o.o. acting as a Data Controller, protects your privacy and processes your personal data only to the extent required for potential hiring.

Based on the above legal basis and in accordance with the stated purpose, we collect and process those personal data contained in your application and CV, as well as the results of your psychological assessment.

Giving access to your personal data is voluntary, which means you can completely or partially withdraw your consent at any time, without penalty or explanation, in other words withdraw it and ask for seizing any processing activities of your personal data. You can send your consent withdrawal to the above mentioned address or email it to privacy@bornfight.com. However, by withholding this information, we will consider that you have also withdrawn your application for employment.

You can request access to your personal information and ask for correction, revision, or amendment of data at any time. You can also request access to your psychological assessment results.

Method of processing personal data

We process personal data fairly, legally and transparently and we make sure that we have accurate, complete, up-to-date and secure data at all times.

We assure the protection of personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (hereinafter referred to as “GDPR”), Act of the Implementation of the General Data Protection Regulation (Official Gazette, No. 42/18) with the application of appropriate technical and data security measures against unauthorised access, misuse, detection, loss or destruction.

We are not responsible for making sure that the collected personal data is accurate, complete and up-to-date, if you do not promptly report the change to us.

By submitting the application and supporting documentation, you guarantee that the data you have provided to us for this purpose is true and complete, and you confirm that you have taken note that we will process your personal data above.

Personal data storage period

Your personal data will be processed for the purpose of carrying out the selection process for the selection of candidates for employment, which includes psychological testing, which will be carried out in accordance with the The Psychology Profession Act (Zakon o psihološkoj djelatnosti) (Official Gazette, No. 98/19.).

If you are not hired, all collected data (application and supporting documentation) and the results of the conducted psychological testing will be destroyed and deleted from all our records, unless you allow us to store your personal data and the results of the conducted psychological testing for the purpose of future potential employment.

In this case, your application and supporting documentation, together with the results of the psychological testing carried out, with your consent, will be stored in the open application database for future employment for a period of 24 months from receiving your consent for such data storage. At the end of this period, we will delete all collected data from all our records. 

Recipients or categories of recipients of personal data

We respect and protect your privacy, preserve the confidentiality of your personal data and enable access and communication of your personal data exclusively to our employees and processors who need the data to carry out business activities related to the nature of the work they perform.

Policies and procedures related to handling personal data, and physical and technical security data protection measures are implemented in compliance with GDPR requirements through internal regulations and decisions related to GDPR implementation.

After storing your CV in our open application database, your data - open application and CV, are accessible to Bornfight employees involved in the recruitment process, mainly the responsible persons from People Operations and, in some cases, selected Managers.

Bornfight is obligated to secure your personal data and will not share it with 3rd parties without your explicit consent, except to:

  • service providers that we engage as processors to perform work related to employment (for example, doctors for the purpose of determining medical fitness prior to employment)

  • government authorities for the purpose of performing tasks within their jurisdiction (for example, the Croatian Employment Service)

  • when this information is required by a court or a state attorney's office, or other bodies in equivalent legal proceedings

  • when we are obliged to provide this information by law.

Your rights related to personal data processing

As long as we are processing your personal data based on your consent, you have the right to:

  • request access to your personal data, 

  • change or delete your personal data

  • limit personal data processing

  • object to personal data processing

  • data portability (when applicable)

  • withdraw consent 

  • lodge a complaint with the national Data Protection Authority - Croatian Personal Data Protection Agency (AZOP)
